OSER Consumer Fraud Complaint

     

2011-10-13 : I have filed a consumer fraud complaint against Oser Communications naming Steve Fox and Todd Powers.

Oser Communications and their publication Consumer Electronics Daily News (CEDN) enticed me to advertise in CEDN published for the January 2011 Consumer Electronics Show. My story is identical to the others posted here. Last minute cancellation, great deal with huge discount etc.

Oser claimed great distribution with hand distribution, rack distribution, show floor distribution and hotel distribution. Oser, however, failed to include several important facts. The convention center distribution is limited to their booth only by contract. Their hotel distribution does not include the major hotels partnered with the convention. They are barred, by contract, from distributing CEDN anywhere on the convention center premises, with the exception of their booth.

Arizona consumer fraud is defined (Consumer Fraud Act A.R.S.§ 44-1521 through 44-1534) as; "Consumer fraud is any deception, false statement, false pretense, false promise or misrepresentation made by a seller or advertiser of merchandise. In addition, concealment, suppression or failure to disclose a material fact may be consumer fraud if it is done with the intent that others rely on such concealment, suppression or nondisclosure. Merchandise is broadly defined to include any objects, wares, goods, commodities, real estate or intangible items, such as services."

The key section here is, "[C]oncealment, suppression or failure to disclose a material fact may be consumer fraud if it is done with the intent that others rely on such concealment, suppression or nondisclosure."

Oser deliberately conceals the fact that their magazine will not be distributed at the entrance to the convention center by hand models or in the main magazine racks where the vast majority of show publications are handed out or picked up by show attendees. Oser claims to be honest about their distribution but the failure to disclose very important facts that they are NOT distributed in the general population is a deception.

My filing is a matter of public record with the Office of the Arizona Attorney General, Consumer Information and Complaints, 1275 W. Washington, Phoenix, AZ 85007. I have also filed a complaint with the Consumer Electronics Association, the organizers of the trade show.
