Merin filed suit against Santa Cruz County in February 2008, claiming officials at the county jail subjected all incoming arrestees to strip-searching, regardless of their alleged offense and prior to being arraigned. Such a practice violated the arrestees' Fourth Amendment rights, the suit stated.

Builders worried about being unable to meet development deadlines in the face of the building and economic downturn could get a reprieve under a proposed amendment to the county zoning code.
The amendment, which is up for vote by the Pima County Board of Supervisors on Tuesday, would give developers the option of adding a year to the shelf life of development plans, tentative subdivision plats and Type II grading permits, said Chris Poirier, county land-use planner.
One goal of the proposal is to improve consistency within the county zoning code by making the timelines for each of the permits exactly the same, Poirier said. Though the amendment will make the building process clearer and consistent, this is not its only intention.

Metcalf argued the ruling amounted to prior restraint, thus violating the newspaper's First Amendment rights.
Only if printing the witness's name violated a defendant's Sixth Amendment right to a fair trial would the First Amendment not come into play, Metcalf said.

LaVoie, who testified he is the pastor of the Church of Liberty, "has every right under the First Amendment to freely exercise his religion, which religion includes offering comfort through the laying on of hands," Roach wrote in an objection to the proposed order of forfeiture.
In court papers Roach also argued that ordering LaVoie to stay out of the massage business permanently based on a verdict in civil court is fundamentally unfair in violation of the due process clause of the Fourteenth Amendment.
